Another win at SBA

A second victory for our client at SBA's Office of Hearings and Appeals: following on the heels of a helpful decision for them at the U.S. Government Accountability Office, our client recently received another positive result on our appeal to SBA regarding a protest filed by a competitor. Both decisions were the result of protests filed with GAO and SBA concerning the small business status of our client. The June 2021 SBA OHA decision overturned an SBA Size Determination that erroneously concluded that our small business client was affiliated with its large business subcontractor, and thus was ineligible for award of a small business set-aside contract awarded by the Department of Energy.
